My SD16 Yukinojo was stolen through eBay fraud, do not trust 1hotsteelersfan

I wish I could send you some money to help pay for your lawyer...Really, you arent just helping yourself...you are helping anyone who has been scammed by this person and saving people from future scams! Uhm...not to sure people would bite so the best I can do unless people really would help get this scammer is thank you for helping to stop him. Anyone of us could have been next.       Anyhoo if the other member is threatening you with negative feedback and you have that email documented with headers and all you can actually report that if it happens. In most likelyhood it would probably get removed through eBay feedback removal policies if I remember them correctly....

      well it sounds like you have it all handled :) um so I guess what I have to say now is probably just stuff to know for the future :) I kinda bullet pointed it all so it's easier to read. I don't know all the ins and outs of all parts of eBay and there are some things I can't elaborate on so just some generals for you :)

      1) Feedback: you can leave feedback for a member within 90 days of the end of the listing (guarenteed) sometimes a little longer (unless the listing is in violation of an eBay policy in which case it might be removed from the site). However if they become NARU then you won't be able to unless they become registered again. So keep an eye on the account just in case since there might be many reasons an account becomes NARU (not a registered user)

      2) User Agreement: states that a listing acts as a legal binding document/agreement between the seller and the buyer. This will hold up in court. Keep a copy of the listing (I'd save it) although it will be accessable on the eBay site for at least 90 days. If it does go down you can request all the information from the old listing by emailing in.

      3) Acquiring address and personal information: You'll be able to get address information through the invoice process on the eBay site. If you still have the listing in your My eBay page you can get the 'payment details' which should have the person's address. Also after the listing ends you can get their phone number, city, state and country with the item number and their user ID. However if you require additional information, espeically for legal purposes make sure that the officer (FBI, Police etc) writes in with the case number and the information needed. eBay will supply whatever information it can especially under these circumstances (as outlined in the user agreement under compliance with law authorities)

      4) Whenever dealing with high ticket items like this whether buying or selling, use a -recognized and trusted- third party (typically Escrow) service. This may cost a few extra dollars but will save -so- much heartache as well as headache. eBay recommends one Escrow serivce (as there have been scammer Escrow services out there in the past)

      5) Feedback soliciation - I think the threatening you received falls under this but I'm not 100% sure. However using the Squaretrade mediation service will also help remove negative feedback in situations where it aught to be removed.

      6) Trades on eBay - I sell regularly on the site. I've never traded, so when you're doing something that's not typical on the site I strongly strongly recommend taking extra precautions - check the buyer's feedback, see if it's mostly from selling or buying, what is their recent track record, do they have any negative feedback, have you contacted that other member to see what the story is? If they have low, questionable or no feedback, seriously consider more safeguards for yourself. If they're refusing to provide images of the trade item be suspicious, you have every right to - while 99% of the people on there are good and won't screw you over, it's better to be safe than sorry. If you don't feel comfortable for whatever reason, don't go through with it - your gut instinct is picking up on something that maybe your conscious mind hasn't figured out, there's usually a reason.

      7) Policing on eBay - I was going to write something on this...but on second thought I'm going to leave this can of worms alone. I have my own views on this which will probably differ than a lot of peoples'. If you're interested in knowing what I think just PM me.

      Anyhoo I really hope you get your doll back...I agree with a lot that others have said here so there's no point in reiterating it :) If there's anything you have specific questions about on eBay you can ping me and I'll help you as best as I can

    22. I've been reading this time to time, and I just remembered that Kenneth Snyder (aka Kenishi) contacted me once about doing a faceup for him. We exchanged a few e-mails, then he dropped off the face of the earth when all the big lies and scandal started a year or so ago. He used [email protected] to contact me. I would recommend anyone here avoiding anyone with that e-mail or a similar ebay account (if one pops up).

      I'm so sorry to hear about your doll. :( I hope that you can find your Yukinojo and I hope that everything works out for you. It's terrible that this happened. :(

I didn't know you could mail in for it, thanks for telling me that. And yes, I have all the address info. I looked into escrow.com, but they don't take the merchandise, they only handle the money and there was no money involved. I tried to use an eBay consignment store as our 3rd party but that didn't work. I signed up for SquareTrade but since the scammer never responded to their emails they coudn't do anything. I'm sure your advice is helping everyone. :) *hugs!*

      The scammer had been talking with me again, they were afraid of the lawyer stuff, I think. I had been trying to nail them down to a promissary note so they could repay me for the doll in installments. It was going to be awful, it would have taken 10 months. But in the end he/she never got the promissary note notarized, probably because you have to prove your identity to a notary very thouroughly. So finally, after all these months of angst, they said they would send me back my doll! I can't WAIT! I hope it's true!!!! EEEEEEK!!!! YAAAAAY!!!!!!!!

      I was so floored, I had been so sure I would never see him again. I had met someone else on this forum who had been scammed in the same way by the same person, and in the end she got her doll back too. Her story was very encouraging, but I didn't think I'd ever be that lucky!

      And yes, I am definitely keeping him forever this time. :-D OMG

    39. hi! I just finished reading the thread and I'm very glad you're getting your doll back! Just a question, maybe I missed the answer 9 pages back! lol... but did you send the doll BEFORE you received the trade doll? cause even if they are trading with you, you should consider their doll as payment, and as an ebay seller myself, I never send out the item until I've received payment in full. That way if it isn't what you agreed to you could have sent the doll back without losing your boy. Just a word of advice for the future, especially when dealing with something so expensive and more rare.

      I'm glad things seem to be working out though. I was scammed myself by an ebay seller when I first started. Luckily it was only like a 30 dollar transaction, so I wasn't too upset, but something this huge would have seriously put me in the nut house! LOL! So I hope all works out for you! Update us when you get your boy back!

      1) you can keep it as compensation for the lawyer because that was money out of your own pocket (or)
      2) you can send him a bill for your lawyer XD and send the doll once your lawyer has been paid for ^_^ lol or whatever you FEEL is right ^_^

    45. well now it depends. Did you pay for the lawyer and if you did, you'll have to have it agreed upon that the doll she/he sent is compensation for the lawyer cost. Otherwise you may have to take the claim to small claims court.

      unless there is a significant loss of money due to the criminal act, you can not keep the doll. For example, if you did not actually have to pay the lawyer for the consultation, and you do get your doll back in the SAME condition as when you sold him, then you've been made whole and you have to send back the doll.

      If you lost money that is equal to or greater than the cost of the doll he/she sent you, then you have the right to ask them if she/he wants to use the doll as compensation or if she'd/he'd prefer to pay out of pocket and have the doll sent back when payment has been made

      if there is no meeting of the minds based on the out of pocket expense you've accrued due to the malice of the individual who tried to defraud you, I believe you can't legally keep the doll and say too bad so sad, you'll have to take that person to small claims court and either say you want the doll as compensation plus court costs, or the cost of what you lost plus court costs with the agreement that you will return their doll to them once payment has been made.

      most courts will do a "you have 10 days in which to pay the plaintiff back or they can keep the doll as compensation." just so that it is fair if you win you're not out anything if they stick you again because you'll still have the doll. but if you do get the money back, there will also be a certian amount of time that you'll have to send the doll back.

      Legally speaking, keeping the doll without agreement to do so as compensation is called taking the law into your own hands, and/or holding property for randsom. Even if you're in the right, which you are, courts don't like that kind of thing. There has to be a meeting of the minds that say "yes keep the doll for all you're out" or "No I'll pay you then send the doll back" or you have to go through the court system. because you don't want them to come back and bite you in the butt for keeping their doll. Courts may find you in the right, but the way you tried to get compensation for the action wrong, and that could screw you.

      (Just speaking as someone whose brother worked for the court systems when he was a bailiff before he went onto road duty as a deputy sheriff.) he saw this all the time with all different kinds of property. especially in roomate situations. One roommate moves out without warning and sticks the other with the bills, so the other roommate holds the property left behind randsom until they get paid the half of the bills the feel they're owed. Legally they can't do that even if they really ARE owed the money. they have to file a claim through the legal system for all they are out. So you're kind of in a touchy situation there.

      You'll have to ask them for money, ask them to keep the doll as compensation, threaten them with court or take the loss and be happy to get your boy back. Otherwise you may get sticked for doing something not considered legal even if you're in the right. Law sux that way.

      its just advice because I don't want you to get sticked again. You've gone through enough. So I say do it the legal way so you have recourse if they try to stick you for all you're out And they can't come back and say "But I was threatened by them saying they're going to hold my doll hostage. unless I pay."

      Also- if you do come to an agreement without having to go as far as small claims- I'd make her/him sign something that says if they don't hold up their end of the bargin you have the right to sue (or keep the doll if its the case that they want to pay you and get their doll back in return.) Usaully courts accept email documents as long as you keep all of them as proof and in its original form as it was sent to you.

    49. I don't think you should keep the Souldoll doll without figuring out the legal details of that, as said above. 'Cause getting your own doll back and then saying "Nyah nyah, I'm keeping the Souldoll" makes you just as bad as the scammer.

      Not that I think you would. ^_^; I know it's a tempting thought, but that's an easy way to just prolong this whole mess of troubles.

    50. Once you get Yukinojo back, the first thing to do is document his condition. If he is in the same condition that you sent him out in, then it is up to your legal team to decide the fate of the Soul Doll.

      If, and dear Light forbid this, Yukinojo has been modified, damaged, or in any way is different from how you sent him, then it may be a case of using the sale of the Soul Doll to recover the cost of the loss/damages incurred. Again, check with your legal team.

      In any case, congrats for sticking up for yourself, fighting this scammer and making it public! Here's my best hopes and prayers that your boy comes home safe and sound, untouched by heathen hands.

      Seasons Final Colours: Yes, earlier I had been wondering if this was the same Souldoll I saw that the scammer had sold under one of his/her older eBay IDs. So I emailed the winning bidder. Much later they finally emailed me back and said that they had got their doll, so I guess it's possible the scammer legitimately bought this one. Maybe. Though it's weird that they'd have two of the same type.

      Hahah, Callie-chan, yeah, there's no way I'd want to be as bad as this scammer jerk. So it if is the right legal thing to do to send the Souldoll back, I will do it. Though I WOULD like to keep him for pain and suffering.... :-p

      I too recommend everything Aravynandrea suggests since the last time you want or need is for the scammer person to turn around and do the exact same thing to you even though they're the bad person.     54. if he comes back in the condition that is worse than when you sent him out, it is the same thing. You have to look at your legal options.

      Give them the choice of the doll to compensate you, tell them to pay for what you're out including the damage to the current doll, or threaten them with court.

      Scamming jerks like this will 9 out of 10 want to avoid going to court because they know they'll lose. If he's an idiot besides a jerk, just make sure you have all emails you've exchanged, pictures of your doll in the condition he was sent in... pictures of the condition he was returned in, and it wouldn't hurt to have those who were scammed by this same individual to make notarized statements if you can find anyone.

      the more steps you take to be compensated legally, the more understanding the legal system is to those who've been wronged.

      they get a little colder to those who've been wronged when they try to take matters into their own hands before seeking legal help. It makes a bigger mess for them and they hate that. lets hope it doesn't have to come to that though. :)

      well i'm just glad your getting him back and the horrible scammer got caught, i have been scammed a couple of times on ebay and nothing has ever been done cos i either didnt pay enough money for the item (but made up for it in shipping) or the time had expired (which i didnt realise, as the seller kept asking me to wait a little longer) i should of known really >< :(

    58. I decided I would pack up the Souldoll today so I can ship him and get him out of my sight if my Yukinojo arrives in good condition. I haven't even touched the Souldoll because I thought the police would take him for evidence, but they didn't. So before I packed him up I had a good look at him and took some pictures. I had a really good laugh over his body blushing. He has...hair...down there. It looks like it was all done with colored pencils, or even crayons on some spots. He has lots of blue-green veins drawn in too, but my flash washed most of them out.

      He came with a small doll briefcase that had a pair of truly weird tiny love letters in it. One of the letters says, "roommate wanted," and lists the beginning of the Nicole Hayford address. Bizarre, to say the least. Also, on his headcap it says he is a Souldoll Paris. I wasn't sure if he was a Lune or Paris before. The headcap seal also has the number 157 on there, I wonder if that number is a serial or what. Does anyone know?
