      She emailed me on Jan. 25, 2006 that I would be getting a refund. Im still waiting.

    8. I've given up. I really have. And it infuriates me. Yeah, in this hobby $35 doesn't mean much. But it's my money, and I don't like getting *%$@ed over.

    9. same here. only i gave up long before her try at refunds...because I knew it was only a matter of time. too bad..i could use that money...since $50 is all im making in a week now...
       
    10. man i feel so bad for her, i mean its well over a thousand dollars to repay, but at the same time i completley understand everyones anger, as harsh as it seems legal action is definitley the right choice, otherwise there is just no garuntee to get your money back, so id say file a claim or accept that the money might be gone forever..... =(
       
    11. if she hasn't been meeting her timeline, i think it's time to go to small claims court. the longer you wait, the weaker your case gets and the longer time she has to dissapear.
       
    12. Well, I received my refund on the 31st of March, so tomorrow will mark the 6 week point from that date, which was supposed to be the first. She said she was going to send one (or two) every two weeks, which means, tomorrow she should be sending AT LEAST her fourth refund.

      I know I didn't notice I had gotten mine yet until a little while after the fact, but I like to live with the assumption that not everyone is as brain dead as me >.>;. Not to mention she posted that she had sent the first one, and has not made a post since announcing any others.

      Now, I realize that sometimes people lose Internet, hard drives crash and computers explode, but there are public venues such as libraries and colleges that offer Internet access, so I never really found the "my Internet isn't working" bit to be a valid excuse for not posting an update of some kind.
       
    13. Well it's pretty sad that she doesn't seem to be refunding like she said.
       
    14. Still no word on refunds -- I'm thinking we should proceed with a case against her. Please respond to this thread with your e-mail address if you're due a refund or item from FlightOfSwords, and I'll coordinate an e-mail list so that we can put together the claim.

      On April 23rd she replied to my request for an update and said she was just waiting for her next paycheck to make another payment on someone; I've e-mailed her three times since then, and received no response.

    19. I haven't read all of this but I just want to say that you may have a case for mail fraud. If someone say they will mail you something that you purchased and then they dont- that is considered mail fraud, and carries a higher penalty then just goign through small claims court.

    34. For anyone that is still intrested in getting their money back...she's started posting on LJ again. So she's on the net and we can make her aware of the fact that we want to try and bring leagal acation against her.

      Or is everone on that got ripped off by her willing to just let it go?
       
    35. Hell, no, I want my money back! I actually used a credit card through Paypal and was considering asking my credit card if there was a statute of limitations. (It's been over a year.) :doh
       
    36. I just was saddend by the lack of intrest in getting they money back...I would go and file a claim or something againts her myself but my total was only $53 and the legal mess would be to stressfull and costly for such a partly sum..

      I left a long comment that I originally sent to her e-mail, but it bounced, so I dropped it as a comment and told her she could screen it - but she deleted it.

      The basic gist of it was, regardless of what her current situation is (and she's claimed to me a couple of times that she's just not making enough money to give refunds right now, she's living paycheck to paycheck) that even if she saved up $1 a week, that's $5 a month she could be refunding someone, anyone, on the installment plan.

      I told her that I thought I've been beyond patient (because here she was, asking me again to be patient until her situation improved) and said I thought she wasn't taking the situation seriously simply because no one had yet threatened her with police action for defrauding dozens of people.

      You guys know what recently happened with vanillashine, right? Ashbet sought to bring police action against her, and all of a sudden vanillashine discovered she could find the means to start refunding people and sending their heads back, after all.

      I think we've waited BEYOND long enough.

      I'm pursuing a chargeback through my Discover card, because they've indicated that I can.

      If anyone has FlightofSword's address, through shipping her anything or mailing her a payment, I recommend they file a police report against her. Ask Ashbet whether to file it locally or call and file it in FlightofSwords' jurisdiction.

      I have reached the point where I don't believe she will refund anyone, ever; she is counting on us to drop it and hopes we will forget and the whole thing will "disappear."
       
    49. I've paid via paypal and its been ages so I don't think PP will be able to be of much help. And I'm not located in USA (I was in M'sia when I paid her) so I have no idea what recourse is available to me. The amount I paid is a large one for me so if anyone can help me I'd be most grateful.

      I don't think that she would really want to repay anyone the money anyway, if not we would all have been refunded by now. I really think its now time the authorities come in before it is too late.

      I left a comment on her journal as well but it was screened and has now been deleted (as I can't even see my own comment) I think this is terribly rotten of her, not only to not own up but to not give any explanation as well. What is all that cowardice ?
