Unresolved problem transaction with horus

I hate to do so, but I need people give me some advices since I never met such issue before.

I bought a SOOM R. Hyperon from horus which has a wonderful tattoo on the body. I do like it and it seems so gorgeous in the pics. I asked about the shipping cost in a cheaper way. Then horus said she can do $798 included EMS. But when I sent the money, she said she only received $762.59. I reviewed her thread and told her she didn't menthion she will charge paypal fee. And I would have to pass it since that will be out of my budget and US dollar raising too fast recently( in fact, at that time the exchange rate is 6.52, now is 6.65) She said she didn't know paypal fee should be announced. But she still want me to take the doll. Then she told me shipping company said it will take 7-15 days to arrive. I knew it is impossible since Vietnam is so close to China. She must change a cheaper way to send the doll to me to save the cost. I entirely never mind and told horus it is OK with me.

Yesterday when I received the doll. I found he has lots of stains in his body. But horus never menthioned in her thread or pics. Never told me about them before or after I paid. They are dyeing by clothes obviousely. They can not be removed just by water. And if I wipe them by propylene, the MCS cover of the body and tattoo will be entirely destoried. I feel really disappointed with this unexpected issue. I PMed horus with pics of those stains. I said I would like to hear from her first.

She just appologized and said they are dirty and dyeing by clothes. She want me to wipe them myself. I said I don't wanna destory his tattoo which made me deciding to take him. If I knew he is such condition, I won't take him at all.

Then horus agreed to return the doll and I received $762.59 as a refund. At first I thought paypal didn't return the fees. And I was fool to tell horus if she wants me sending the doll via EMS which calculated by volum and equal to 11kg. I hope she could share the shipping cost with me. Or I just can ship via airmail. I was fool to think she spent the shipping cost to send the doll to me. So I would like to lose some money to send him back. But then I realized the shipping cost was spent by myself indeed. And paypal told me horus didn't choose a whole payment refund. That $35.41 has came to her own account. I PMed her again to ask if she did a mistake operation? At that time I still thought she is good to work with. But she replied to say that she just received $762.59 from paypal. The doll has no any damage and with joint hands and she used fast shipping to send him to me. Now I don't want the doll, so she just wanna send me back the money that she received.

She sent several PMs next. One to say she spent extra shipping cost herself. One to changed her mind to say she can send that $35.41 back to me if she can receive the doll in 7 days safely and sound with fast shipping as she did.

I reminded her that I didn't force her to sell the doll to me when paypal charge fees. I would like to pass the doll but she wanted me giving her my shipping address. I told her I never say the doll has damage. I just have my opion and right to buy a doll or not at the fair state. That is, the seller should tell the true condition of her doll. He has a condition that I can't accept no matter he has no damaged or has joint hands. It is maybe a good deal to others who didn't care about his stains, but not me.

Horus replied to repeat she will refund that $35.41 if the doll arrive in 7 days. I was curious why she sold a doll without telling buyer the true condition and still want the buyer cover the loss. Now she forces me to sending the doll with fast shipping in 7 days to her which will be calculated as 11kg. Otherwise she won't refund my $35.41, let alone she will cover the returning cost. I would like to know if it is fair with me.

Horus PMed me here today refusing to cover the shipping cost and said I'm unreasonable. She said if I don't cover the shipping cost to her, I shale pay the money back to her and keep the doll myself to finish this transaction. She had no any word to say why she didn't tell the truth about the doll. Is this reasonable? I contacted with my EMS agent today. EMS to Vietnam is $122. Something like priority is $61.5 but will take 15 working days. That mean, if I don't spend $122 to send the doll back to horus, I will even loose that $35.41. I feel really upset and I'm going to dispute by paypal later.

 

I would like to speak to everybody. DOA has a very detail selling form. Please do describe your items with the true condition. This is responsible for yourself and the buyer. And to the buyer, we should ask for the detail pics before we paid or after that. It is really important. I feel so pitty that horus didn't tell me the real condition about her doll and would not be responsible with it when I reported the problem to her. That's why I chose a refund. All of these issues should not happened indeed. And I hope everyone will not meet this kind of thing at all.

 

I feel little curious. Don't you think it was not a fair deal from the begining? Although you said this is the first time you sold a doll in DOA. But you are not a new one as a bjd holder right? So I ask you please to think about it from the perspective of a buyer too. We both know besides damage, a good, gorgeous faceup or body painting also be a point to people who will take a doll. I think you knew that as you said in your thread to say he has a brand new face up, tattoo and blushing, he is gorgeous. You supplied beautiful pics of him. People can not imagine a brand new painting will has lots of stains on it. Please think about it. Why you didn't tell the truth before shipping? I don't wanna judge anything. So when I found the problem, I didn't accuse you. I just reported to you and want to see how you would say first. I thought if you just want me to keep him. OK, I've paid for him and he came to me indeed though I felf so disappointed with him. But at least you should pay me some money for these ruined painting which makes your doll seems not so gorgouse as an honest buyer should do. Your response let me made up my mind to return him. And I also considered to cover the shipping cost to send the doll back to you by airmail or asked you to sharing the cost if by EMS. I PMed you for all of these right? But you never mentioned why you didn't tell me the truth of your doll, you just repeated again and again you would refund that $34.51 if I could ship the doll with fast shipping in 7 days to you. You always said you used a fast shipping to me. So I should do it for you myself too. But it was you who asked me $48 for EMS. I paid for that fast shipping. And if China EMS do not charge by volum now, I can do it for you too. I really can not feel honest and kind from you and I won't pay for the mistake transaction anymore. If you need your doll coming back, please send me the shipping cost on whatever method you like. I will pack him very well and please check him carefully before sign.

1. When she told me she would charge paypal fee. I told her it is out of my budget and the US dollar keep on raising too fast. I asked her refund the payment to me. She insisted to ask my shipping information to let me take her doll.

2. When I asked for a shipping cost to China. She said EMS is $48. I paid for this "fast shipping" myself.

3. Those stains were not mentioned or shown in horus thread until I received the doll. They can not be cleaned by water at all unless I use propylene to destory all of his MSC cover and tattoos.

4. horus just wanna refund $762.59 to me at first. I think she would like it for the shipping cost she sent. But she changed her mind later to agree to send me that $34.51 if I can ship the doll to her in 7 days to arrive.

5. China EMS charges package by volum instread of weight from this February and if people watch my selling threads before, they must noticed that I said I won't included original doll box and will unstrung the big doll into a smaller box to save the cost. And the EMS shipping cost to Vietnam is $122, not $161. I have all of my transaction records with my EMS agent in Taobao.com where I sending shipping cost to them.

6. horus said I am unreasonable and it is unfair to her. But I think the real unfair thing is horus didn't menthion the real condition of her doll according to the regulations of DOA. And she was not responsible for it when I reported the problem to her. So I decided not to cover the returning shipping cost now though I was kind to mention it to her before.

7. I can keep the doll carefully in the box till horus tells me how to treat for him. She can also re-list him here and I can help to ship to the new buyer if she needs. (Please note that if you use EMS, the postage will be very expensive included doll box).

 

I don't want to keep you doll. You can send me the shipping cost in anytime to bring him back with his everything. You can contact with me about the whole shipping options and fees. I will response on Monday when my EMS agent on work. I don't wanna hear those excuse from you again and again though you never mention about why you purposely conceal the truth condition of doll. Next I will take pics for everything that horus sent to me this afternoon or tomorrow before I send him to my EMS agent. I will also supply the pics of packing and list all of these pics in this thread.

 

To evaluate my action, let see the whole things:

* horus list a R.Hyperon in the MP. She described him is a gorgeous doll with brand new faceup and body painting. She supplied beautiful pics of the doll ingeniously conceals his own defects.

* horus asked $48 for EMS shipping and I paid $750+$48 to her promptly in full.

* horus told me she would charge paypal fee. I ask her for a full refund since the price was out of my budget. She didn't do it and insisted to let me give her my shipping information to sell the doll to me.

* I received the dolll and found the he has many stains on the body especial on his tattoo which can not be wipped off by wather. If I wipe them by propylene, it will destory all of his MSC cover and the beautiful tattoo.

* Although I knew horus didn't mention them in her thread and I felt so disappointed with the doll, I still didn't accuse her. I just reported to her about the stains.

* What I didn't think of was horus didn't take these stains as a problem with her doll. She said he has no damage and just let me wipe them myself. I thought if she concealed the real condition just need I taking him, now the doll arrived, she could just made a little compensation to let me keep him. At least I can send him out to let people remove his heavy painting. There are person who will do this big work and charge money. But it also means I will lose his beautiful tattoo.

* I can't accept the doll as such condition and horus' attitude. I asked for a returning and she agreed.

* I PMed horus to say that I could cover the shipping cost to send the doll back to her via airmail and asked if she would like to sharing the shipping cost if use EMS.

* I found horus just refunded me $762.59 and I thought maybe paypal charged this fees. I called paypal and they told me that $34.41 had already arrived to horus account. So I was fool to ask horus if she did a mistake operation when she refund to me.

* horus replied that since she just received $762.59 from paypal, so she just wanna return this amount to me.

* horus PMed me again to change her mind. She said she can refund that $34.51 if I could ship the doll back to her in 7 days arrived. She said since she used the fast shipping to me so she wanted me to do the same.

* I contacted with my EMS agent to ask for the cost. Since China EMS calculates package by volum so the doll should be qequal to 11kg and the EMS shipping cost to Vietnam is $122. And a cheaper way should takes 7-15 days. So if I couldn't ensure the doll arrive in 7 days, I will also lose that $34.51 too.

* Since we opened this thread here, horus repeated many times in the thread she just will refund that $34.51 to me if I use the fast shipping to her. She never talked about why she deliberately concealed the truth of the doll. She didn't take them as a problem and thought it is necessary to compensate me about it. I can't feel honest and kind from her so I decided no to cover the returning shipping cost to her at last.

* horus said I have no right to keep her doll, I should use fast shipping to send him back. I should cover the cost. The stains can be easily removed, balabalabala......

* I announced in this thread before I went to bed yesterday（Chian time）that I don't wanna keep her doll and I will ship him as soon as she send the shipping cost to me. I will ask for all shipping methods and fees on Monday as soon as my EMS agent on work.

* Today when I woke up and visit internet, I saw many emails and PMs from horus. She said she had refunded my $34.51. She agreed to send her doll back via airmail but she wanted me pay back the money she sent the doll to me. She asked moderator to paging me and said if I won't reply her she will sue me since she had refund all of my money but I still have her doll. I felt very funny since I am not 24 hous online to reply her whenever and wherever possible. And I replied her email earlier to repeat that I will let her know the shipping cost on Monday when my EMS agent on work. I can no as her request to send her doll tomorrow promptly.

* horus sent me an email just now to say : "I will accept using airmail instead of ems, because you have acted wrongly in the repayment agreement, so I will pay as soon as receipt of shipping bill because I can not trust someone like you." I replied that she can send the money to my EMS agent herself in Taobao.com via Chinese money. And I hope she could contacting me in this thread in stead of PM me or sending email. I think people would see who is the one not to worthytrust.

 

horus sent me an email to let me ship the doll to a Chinese address with COD. I replied I don't know what is COD but in China we only ship Shunfeng express which is the best express here to sending bjd. She won't need to send money to me. It can be paid by recipient when signed. The price is equal to sending from my side. I detaily told her about the price and time. It will take $14 to arrive in 2-3 days by airmail or less price later one day by car or train. She can even buy insurance which will cost 1/1000 of the package value.

I also told her I've token pics of the doll and packed him. He was ready to ship. She just replied to let me do it to her friend address. I told her I need her confirm everything after I put the pics in the thread.
