Negative Feedback Problem Transaction with Eldurwen

    1. I responded to Eldurwen's WTB thread in the Marketplace for a Soom Rosette Pure Lady body. The transaction was pretty smooth and communication went well until a couple of days after she received the body. The message history is screenshotted and provided below. Despite Eldurwen implying that I sold her a recast, I continued to try to resolve the situation fairly. Before I was able to respond to her last message she opened a dispute on PayPal which has prevented me from using my account for any other transactions. My PayPal is a business account and is used for many things besides doll stuff.

      I am very displeased that despite her having been in the hobby at least since 2009 that she didn't bother to do her research on the doll body in question prior to implying it was recast. Even though she her implications were unwarranted I still continued to converse with her in a pleasant manner and was doing my best to resolve the situation. I asked her what specific photos she wanted, whether or not they were showing up for her and if she wanted any other specific photos. I did not mislead her in anyway and yet she is claiming via PayPal that "Item not as described: There is significant damage (chipping & scratching) to both wrists that was not disclosed nor visible in the pictures provided."

      By her own admission, she and her fiancee inspected the body and compared it to the similar dolls they had of their own. Rosette wrists and ankles are extremely fragile and could have easily been damaged during their inspection and unstringing. I know that her arms were strung much tighter than the rest of her because this tightness had resulted in the eye hook of her original hands to come out making them unusable so I replaced them with a spare pair that I had.

      This body belonged to that of my favorite doll and I paid a lot of attention to her. I am certain she didn't have the small chip on the wrist/forearm. I can't be positive that the part of the wrist ball that isn't typically visible wasn't damaged but given her age and use they may have been.

      I am going to attempt to resolve this via PayPal. Please note that after her last message she didn't give me a chance to respond whether or not I would refund her before opening a dispute and after opening the dispute has not indicated that she would return the body.

      I would be very cautious if considering selling to her.

      I see that you have escalated the PayPal dispute I opened to a claim.

      I opened a PayPal dispute because there is a limited amount of time to do so after the date of purchase, PayPal states you should open a dispute "right away", and I wanted to ensure the option was still available to me.

      I am absolutely sure the damage was not caused while unassembling. I have been in this hobby over 7 years, I would not be that careless with a routine unstringing. The wrists were only taken apart for clearer photos AFTER we saw the existing damage.

      It was made known that this doll was from 2011. I have a Rosette of my own from 2011 without anywhere near this level of wear/damage, so the age did not deter me, nor was it taken as a warning that there would be undisclosed damage.

      The photos you provided where the channel of the wrist was showing were blurry to the point where the damage was not visible. The exception to the blurriness is this image:

      I have been in the hobby for over 7 years and made many purchases of used/secondhand dolls, and I understand some level of aging and "used" condition, but I've never encountered undisclosed damage to this extent before.

      If I was aware of the wrist damage prior to paying, I would not have decided to go through with this purchase. I assure you I have no desire to keep this body, and no intention to ask for a refund without sending the body back to you.

      I would be most happy to return the body for a refund. I am willing to settle for a refund of $145, which is a discount of $50 + shipping costs. I would also be willing to pay for the return shipping to you. Does this sound like an OK resolve?
       
    5. I escalated the dispute to a claim in order to expedite freeing up my PayPal account. Unfortunately, I do not have an option through PayPal other than to wait for their decision. It does not give me an option to do anything else. FYI for anyone buying via PayPal in the USA you have 180 days from date of payment to open a dispute on a purchase, this is a change that was made several months ago, possibly a year ago. It used to be 45 days.

    6. I'm not so sure that will expedite the process, PayPal says:

      "Most claims are investigated within 10-14 days or less.

      In a minority of cases, we can require up to 30 days (or longer) to decide the outcome of a claim."

      In the meantime, there's nothing we can do but wait?
       
    7. Update:

      PayPal has ruled that I am eligible for a full refund so long as I return the body by August 12th with online shipment tracking. I will post again once I've shipped it.
       
    8. I have shipped the package today, and entered the tracking info onto the PayPal claim. The estimated delivery date is Monday, 8/08/16.
       
    9. USPS tracking confirms that the package was delivered August 6, 2016 , 10:58 am.
       
    10. I have received a refund from PayPal. I would consider this matter resolved.
       
    11. I would like to clarify a few things.

      PayPal did NOT decide she "deserved" a refund. What I learned after talking to a supervisor at PayPal is that because the transaction occured under Usernames on a forum that they[PayPal] don't have access to, they can not verify that the conversation(aka sale) and product description that took place on DoA are directly related to the names associated with the PayPal accounts. And since they can not verify that Eldurwen and a88_angel are the usernames of the parties involved in the PayPal claim and the description of the item was via that said unverifiable source they have to automatically side with the buyer.

      So although I received the item back in worse condition than it was sent, (as I stated in my OP there was some damage that may not have been visible to me due to it being inside the wrist) there was additional damage that was definitely visible upon return and would have been visible in my original images had it been there.

      I honestly believe that any additional damage was accidental, as we all know, no matter how long you've been in this hobby or how careful you try to be stuff still happens. However, based on the accusation of the body not being legit and the comments about the color and texture of the resin I feel this was a case of buyer's remorse. Buying a second hand older doll for hybriding, you always take a certain amount of risk and that is on the buyer not the seller.

      This whole situation has left me feeling like I will never sell anything through PayPal again especially through sources that use anonymous user names. I am not happy with the stress that it caused either party and while dissatisfied, consider this matter closed.
