Payment Layaway - How Long do You Wait for Payment #2

    1. OK I have a girl won't mention names who asked to buy one of my sale BJD on layaway. She made first payment on Jan 6th that is when e-check cleared.
      Since then have not received another payment. I have PM her asking for a time when she will send something, but I either hear nothing or she PM like she hasn't heard from me as she gives me the I haven't forgotten about you line. Still most people after the 30 days of non payment would have said sorry you lost your deposit and now doll is back up for sale. It has been well over that so do I just let her go and put doll back up or do I give her yet another deadline?

      This is first time this has happened to me ever and to have it happen on DOA I am not sure what the protocol is esp. if there are rules. Thanks, MK
       
    2. normally when I accept layaway for a doll or item I set up a specific timeframe with the buyer (or seller if I'm buying) stating that x amount has to be paid by such and such date, with full payment due by (date). If my attempts to resolve issues with the buyer don't actually change anything and the terms of the agreement aren't kept (and if a 'paging' thread doesnt bring about results) I usually keep the deposit and refund whatever amount above that which they paid. I send them a message stating what i'm doing, and put the item up for sale again.
      I'm not sure what I'd do in your situation though. It depends on the terms of the layaway agreement really.
       
    3. if i were you i'd pm her saying that although she hasnt forgoten about you, you cant wait anylonger for a second payment on the doll. Say she needs to talk with you (more than one pm, like chatting) within x days so you can decide on a pay schedule and she can start paying you back. If she doesnt do this (and i have no idea how deposits are supposed to work, but in this case it might just smooth things over if she has never done a layaway before) send her a pm saying you are refunding her deposit and will be putting the doll back on the market.

      if she wants to do layaway with you again set up a pay schedule as the first thing you do before any money has changed hands, and with any other buyer just in case.

      I'm really sorry this happened to you ;_; I once had a doll where they wouldnt ship it to me after I paid in full and that was very distressing. Cant imagine what its like to think you have sold a doll and then hear nothing for almost 2 months after the first payment.
       
    4. I would send her an ultimatum : Pay before X date or I'm refunding the money and putting the doll back on sale.
       
    5. Just to cover yourself, you should send a "last chance" message stating that she WILL lose the doll and her deposit if she doesn't pay you. I'd give her no more than a week.
       
    6. All of my layaways I state that any deposit no matter how big or small is non refundable, in this case she has only paid $60 and still owes $310.00. So if she hasn't under my terms paid within 30 days of deposit she generally looses her deposit and doll is once again for sale. But she kept telling me she would pay something, no worries. But I PM about 2 weeks ago saying I need something from her to hold doll and nothing. So do I say she had her chance and re-sell doll, or do I send another PM and tell her something by such & such a date or deposit is gone and doll is back up for sale?
       
    7. If you set specific terms about when she had to make the next installment by and she's blown it off by just saying 'yeah yeah I haven't forgotten about you' etc then I think you're within your rights to tell her that her deposit is forfeit and the dolls going back on sale.
      If you didn't set a date at the outset though that's a different matter, in that case I'd suggest opening a thread paging her in the problem transactions section and give her X amount of time to make her next payment.
       
    8. I think you should give her an ultimatum date and if you don't hear from her by then, tell her you are re-listing the doll and that she has forfeited the payment. Then, post a notice in the problem transactions/bad feedback thread so other people will know what happened. People like this give layaway a bad name and spoil it for reliable people.
       
    9. I give a deadline on mine to specify how long for the layway. I give a no deposit layaway for a short time - more like a hold - and then I need the deposit for longer layaways - which I would not do for longer than 3 months for sure. I think 2 months is perfect.
       

    10. usually payment terms are set up front. i have only been the purchaser and usually make weekly to no more than monthly payments. most places do 90 day lay-a-way unless something else was set up. i also want to add that i had a major problem with e-checks once (not on DOA). luckily i didnt loose any money but 6 months later the person who bought the item tried to say they were out of the country and their identity had been stolen. my bank account got closed and i actually called the police just to have this on file. it worked out in the end although it was a huge headache and i was freaking out that other bills i had paid would bounce since my account was closed with no warning. i moved my money to another bank and now i no longer take echecks. i would contact her and tell her that she needs to make bi-weekly payments if she misses a payment her money is forfeit and the doll will be up for sale.
       
    11. Thank you all fro your replies and comments. I have PM her letting her know she has 1 week to make at least a payment of $100 on said doll or we consider she has not only lost deposit but doll will be once more for sale. I even went to the trouble of allowing her to buy the head with the body, and it was supposed to be other head body went with, but found buyer for extra head so it was fine. But still wish she had made more an effort. If no reply or money in a week the doll will be back up for sale. MK

    13. I sold a doll in Feb. The buyer put down fifty and has been MIA since (but active on the forum this month). When can I (morally) relist, and if I said it was a fifty dollar no refund deposit, does that apply if I consider the deal abandonded?
       
    14. I would send them one more message (if you haven't done this already), possibly also to their e-mail/paypal e-mail account if you have it, informing them that if they don't contact you by X date, you will consider the layaway deal cancelled from their end and will re-list the doll. If they don't contact you and/or offer a reasonable explanation, simply keep the deposit and re-list the doll.
       
    15. That's quite a period of time for no contact. I would assume you have messaged them probably multiple times and well.. One can only be so patient. If the deposit was non-refundable, you have every right to cancel the layaway and try to find the doll a new home. Four months is a bit of a ridiculous amount of time to not be able to at least sign on somehow and shoot over a quick PM. I can imagine you would feel horrible, but sometimes it just has to happen.
