Lost/Damaged I take it I should just bite the bullet..

    1. I'm sorry if this is in the wrong forum, but I need some advice guys. So a long time ago, in 2020, I had gotten into the BJD community. I was unknowledgeable and quite naive. This is without a doubt, my fault. I would also have to go through years of messages but I have the main screenshots. Again a lot of this falls on me, but I should have known. So I found someone on Instagram willing to make me 2 twin BJD dolls. I paid of a total of 1,000-1,200 USD this is what i calculated so far with the screenshots i have alone and i haven't even gone back further.

      So lots of things happened, she moved, I moved, COVID, and her life kind of went downhill. Real life also happened which again I take accountability for as I've moved a series of times, and got a new career and family. Within that time up until now, I also paid for Loong Song Moon rabbits from a long-ago event and the jointed hands she has. Again, we've always kept in friendly contact like how are you, feeling better, have a good day but i never wanted to pressure her into focusing. She was supposed to work on the bunnies alone in September, it is now almost February, and she's had the hands since July 2021 and the bunnies since May 2021. I had given up all hope for the dolls and just wanted these two, but now even these are proving to be a mission to get.

      I contacted Paypal to see my options and of course, since I sent it as friends and family it isn't covered, I was told I could call my bank for a dispute, but they would recover that money for me, but it would be taken out on me in my PayPal. So basically my bank would contact PayPal, and get me my refund but PayPal would put me in the negative from what my bank gives me... A lot of this is my fault as I should have been more strict, but now I'm getting upset and desperate for my bunnies plus my money. because i paid for the bunnies, hands and dolls, and i have gotten nothing..
       
    2. It's time to start putting on the pressure. You can't play nice forever and that is far too long to hold on to someone's possessions. Are you sure she actually has them? I would ask her to ship what she does have, unfinished or finished.

    3. she showed me photos of the hands and bunnies beside my sculpt she was supposed to finish so she does have them, or HAD them when she showed me back in July of 2021

    4. Have you asked her how long she think it will take before she is ready to ship?
      If so, how does that compare to what you originally agreed to when money changed hands?
      Is she still comunicatiing with you, or has she gone silent?
      Did you have any kind of deadline agreed on?

      Based on what you wrote alone, without having any idea of what else have been said, i don't see anything that confirms that she knows you are expecting things to be finished by now, only dates for when they were being worked on (not sure what you mean, here, is she making the dolls or is she working on mods or face ups or what?). There could be a misscomunication and she is waiting to send you the things she has finished until everyhting is done to save on shipping costs. She may not have a clue that there is a problem.
      If so, simply asking her to send whatever is finished may solve that part of the problem, at least.

      In any case, if you havent already, a bit of polite asking and if that doesn't help, firmer tone, is proabably the next steps. And if it still doesn't work, ask for a refund and give her a chance before involve the bank.

It was agreed upon by her words back in the end of 2020 it would take her around 6 months to make the dolls. sculpt, cast, she was making them by scratch, not a face up, nothing like that. actual dolls. There is absolutely 0 miscommunication in this entire transaction as it has been 3 years. We agreed on 2 dolls being made, face up on bunnies and hands. She's more or less silent, we only communicate when i initiate it.
       
    6. @AidenEsparza In that case, I'd ask for a refund. I don't think I would trust an artist who miscalculated their time estimates that bad to do a good job. Best case scenario, it's a naive sculptor who underestimated how much work it is to make a doll (all beginners do this, but if she is established she should know better) and no malice intended, but she is still responsible for her lack of progress.
      But paying up front for something made to order is often not covered by refund laws, so depending on where you and she lives you may have to rely on her good will to make it right, unfortunately.

    7. First step should be talking to her. If she still talks with you if you initiate it, that's good. Follow the advise @Lillith gave you: Go from "soft pressure" to "hard pressure". First things like talking friendly. Maybe she didn't mean it like that and it just didn't go as planned, but no harm meant. if it doesn't help, become less friendly. Don't say that you understand the situation anymore and that you need either the ordered doll or the refund. After that comes saying that you will take measure, e.g. asking PayPal (even if it's a lie) or, if needed, even through law. Most "normal" people get cold feet at that point. In case it still doesn't help, there should be ways based on law, like going to the police and reporting her for fraud.
