Paging Evelia (unsent doll)

    1. So, Evelia reached me a few months ago (Jun. 29) regarding one of my WTB posts on my profile. She was willing to sell me a Luts DELF 05 Breakaway with a faceup by Asai Nemuri. She messaged me here on DoA and I answered on the same day. A few days passed without any responses, so I messaged her again (on Jul 5), asking if she got my reply and I also asked for pictures of the doll she first sais she had available to sell. On this same message I gave her my instagram account and email in case she wanted to show pictures of the doll through social media inbox, so she didn't have to upload the images.
      She then sent me a message 2 days after (jul 7) on instagram saying that she was sorry for not answering sooner cause she was busy and she sent me images of the doll. She said she was going to ask 800$ for the doll and would accept 3 month layaway. I told her that this price was too high for me (considering the dollar currency conversion rate that is astronomical for my country at the moment and already was a few months ago), so I told her I could pay the price but I needed a 5 month long layaway. She then said the would pack him ahead and that she could take the 5 month. She informed me she was going to move late september and early october so my payment was due november and I said okay.
      I sent her my precise payment schedule (July 18th - Augst 18t to 23rd (due to my payday variations) - September 18th to 23rd - October 28th to 23rd - November 18th to 23rd).
      She agreed with the payment plan. I then explained to her how to invoice me the total value in one single invoice but allow multiple payments so I could complete the payment on the same invoice during the months and she has done so.
      So far, so good, aside from she messaging me to remember to pay before the agreed dates (on Aug 16th she sent me a message saying I should remember to pay and then on Aug 18th she messaged me again to check on me, I sent the payment right away, she only answered me on September 2nd with "thank you"), Then I asked her to remind me about the payment on september cause I was going to have a huge event on my work and I was afraid I would forget, she didn't answer, then I sent the payment on my own on the agreed date. Still in september she asked my adress and I sent her the full shipping info, if she was going to set the doll ready to ship.
      One day prior to the agreed day in October, I sent another payment. She then answered saying the would box him (which he had said in the past but apparently didnt)
      On the agreed date in November (November 18th), I sent the final payment. Then I sent her my full shipping information again. She then answered saying she would do her best to ship him out soon, and "preferably this week" (November 18th was a monday). I reacted to her message with a heart and waited. She then didn't answer anymore.
      On the December 2nd I messaged her asking if she had news from shipping. She then answered saying she meant to update me but she was trying to find a home to live in. She said she needed sometime to find a place to live and that he own dolls sent to faceup were being held by the faceup artist cause she had no address to have her dolls shipped.
      She then proceeded to send me audio messaged.
      I replied saying I needed at least an estimate time for the shipping of the doll cause I'm going to travel after new year's eve and I need someone to be around to collect the box when it arrives.
      She answered with more audios which are terribly unsettling to me since english is not my mother language and I have trouble understanding. But basicaly she said she has no estimate time, she doesn't know where she will live, she could mail me in january or in february, but she kept saying she has all the intention to ship him to me, she doesn't know when. She said that she is charging her phone on a public place and that it was becoming hard for her to charge her phone, that she has to prioritize herself and that she would take care of my situation in a future time, which is completely unfair in my opinion, cause I paid correctly every month and I was not aware that she was not going to ship my doll. She didn't even say that before I asked her myself about shipping.
      I answered saying that I would need an estimate because my travel is for a surgery and I can not just go to another city to undergo surgery and leave the matter unsolved. She just answered me with a picture of a kid's playground, which didn't mean anything to me. I messaged her that I didn't understand the picture and she sent again another audio saying that that place is where she is sleeping, that she has no family and no friends to take her in, that she doesn't have a returning address to write on the box so she could not send it international. I told her I have an US address and she told me that even so she could not send because without a returning address they would not take the package. She said something about being able to ship when she found a job, I offered to pay for shipping again, she didn't even answer that. She said she could ship on february or return a bit of my money back in january or in february, maybe half of my money because that would be all she could pay me back (???? I paid the whole amount for a doll so I'm not allowed to get the doll nor the money back????). But it was all explained by audios I can't fully understand. So I told her that I'm autistic and that the audios and random pictures weren't working for me to understand the whole situation and that she should write me the matter. She proceeded to send yet another audio with a written message saying "I will explain soon once it's within my capabilities"
      Since then she has ceased answering.
      I messaged her saying that I will not just sit and wait for her life to be solved, although I can only imagine what's happening (specially because she won't explain properly to me), I need to have my doll shipped or my money returned, because 800$ USD is a huge amount of money for someone living in Brazil. I can't just let go under no certainty that I'll be receiving my doll.
      I gave her a few days to solve that matter and have the doll shipped or money returned, that was on monday (2 days ago). I went without any answer. I messaged her again yesterday with my full shipping information again. I was informed by paypal that she should ship to my Brazilian address, so I informed again and I'm still waiting for an answer. She has read my messages and has been online the whole day for the past days, just chose to ignore me.

      Now I'm going open with the case. I will appreciate some help if someone knows here on where she lives and if someone is in the same city as her and could possibly get the doll personally and have him shipped to me (I will pay extra for that) or anything like that.

    3. Update on the matter:

      Paypal claims were opened to retrieve the money since Evelia did not plan to send the doll. She claimed she was not able to ship because she had no returning address for the box and that the post office would not allow her to post if she didn’t have a returning address, which is fair, but she also did not want to return the paid money.
      I was able to reach to someone from the doll hobby to help her to ship and provide a returning address for the box and also physical help to take her to a post office and help her pack the doll, but she did not accept this person’s help and so I had to open claims for the payments. PayPal then gave her the opportunity to ship the doll within a timeframe and so she finally did. I was provided with pictures of the package and shipping label and invoice. I also have a working tracking number and Evelia emailed me informing that she has communicated with PayPal on her side and that they provided her with orientations on how to proceed on the dispute. On my side, PayPal strongly advised me to cease contact with her and to cease “alternative” disputes as this could lead to misunderstandings and could delay their official process, since they’re currently handling the issue closely, I think it’s fair.
      On a more personal matter, prior to all of this, I informed Evelia that I would be traveling to another state to undergo a surgery, so now my travel time arrived and I’m not going to be available for a while. For this matter, I left my partner with legal documents allowing them to deal directly with PayPal on my absence. My partner has become a legal representative of myself and will attend to this case. Luckily they’re also experienced in collecting BJDs (more than me, actually, and is also a member of this forum) and will be able to correctly identify the doll sculpture upon it’s arrival and will be able to tell if the doll is in the same state as described in the sales’ information.
      So, on my part I can consider this case as solved, if the moderators are fine with the outcome.

      Once the box arrives, PayPal informed me they will end the case and if Evelia did correctly follow correctly follow their policies, she’ll be able to keep the payments.

      Please moderators let me know how to proceed with the case closure.
